Motor Vehicle Offenses
Many motor vehicle offenses carry “points” against your driver’s license, which can adversely affect your automobile insurance rates. At Hunnell Law, we understand the importance of aggressively fighting to ensure points are not assessed against you. Often times we can ensure a “no point” ticket. Other times, we will work to reduce the total fines you are required to pay. Criminal Offenses
Individuals who face a municipal court complaint must understand that a conviction can carry serious consequences, including a potential jail sentence and fine. A criminal charge in New Jersey requires an aggressive defense, which I am known to provide for my clients in municipal courts.
For non-indictable municipal cases, I generally offer a flat fee scale. I believe that everyone has a right to legal representation, regardless of their income level.

Driving While Intoxicated (DWI)
It can be an extremely stressful and embarrassing matter to face a DWI. You should be assured that Hunnell Law is ready to assist you through this process & guide you in a respectful and cost effective way. Most cases will be handled on a flat-fee basis, so that you know what to expect.
Top Five Things to Know About a DWI Conviction:
5: For your 1st offense, you will be assessed court fines between $250 - $500, plus be required to participate in 12-48 hours at an Intoxicated Driving Resource Center (IDRC) for an additional $330-380.
4: For your 1st offense, you face a suspension of your driving privileges for 3 - 12 months. If your BAC is .08%, but less than .10% you driver's license will be suspended for 3 months; if your BAC is .10% or higher, you are facing a 7-12 month suspension. Depending on your body size, a .10 can be as little as 2 drinks in an hour.
3: The Interlock Device!
If your BAC is below .15% the court still has the discretion to require you to install an interlock device on your vehicle for 6-12 months. If your BAC is .15% or above, the Court is required to impose the installation of the interlock device, during the term of your driver's license suspension and an additional 6-12 months after restoration of your driving privileges.
2: Most people do not receive jail time for their first offense, but the Court does have discretion to order a maximum jail sentence of 30 days for any first offense. If your DWI involves an accident, or worse, bodily injury, jail is a real possibility no matter what your BAC is.
FYI- 2nd offense: 90 days, plus 30 of community service; and 3rd offense: 180 days, plus 90 days community service.
1: You will be assessed a $1,000 "insurance surcharge" every year, for three (3) years for your first offense. If you don't pay the surcharge, that will "result in indefinite suspension of all driving privileges" and a judgment against your personal property.
